Meta Concedes to Data Restrictions in Germany Following Antitrust Battle

After a multi-year legal showdown, Meta has agreed to significant data-handling limitations in Germany, marking a pivotal moment in the intersection of antitrust enforcement and digital privacy rights.

The Landmark Case: A Recap

Germany’s Federal Cartel Office (FCO), known as Bundeskartellamt, initiated this groundbreaking case in 2019, challenging Meta’s practice of “superprofiling”—the consentless cross-site tracking of users across Facebook, Instagram, and third-party platforms. The regulator argued this constituted an “exploitative abuse” of Meta’s dominant market position.

The case concluded this week with Meta withdrawing its appeal against the FCO’s order, effectively cementing the regulator’s victory.

Key Changes Meta Has Agreed To

As part of the settlement, Meta will implement several user-centric data controls:

  • Accounts Center: Introduced in June 2023, this feature allows users to segregate data collected across Facebook and Instagram, preventing Meta from combining it for ad targeting.
  • Enhanced Cookie Settings: Users can now choose whether to allow Meta to merge their activity data from third-party websites and apps with their social media profiles.
  • Facebook Login Exception: Users opting out of data combination can still access Facebook Login without losing functionality—a significant shift from previous restrictions.
  • Security Data Limits: Meta will temporarily store combined data for security purposes only, with predefined retention periods.
  • Transparency Improvements: Clear notifications will direct users to privacy settings, and Meta’s data policy will prominently display options for data control.

Why This Matters: The Bigger Picture

While these changes stem from a German ruling, their implications could ripple across Europe. FCO spokesman Kay Weidner noted that some measures, like the Accounts Center, are already being applied EU-wide.

The Battle Isn’t Over

Despite this victory, Meta continues to face scrutiny over its “pay or consent” model in the EU, where users must either agree to tracking or pay for ad-free access. This approach has drawn criticism from:

  • Data protection authorities
  • Consumer watchdogs
  • The European Commission (which is investigating Meta under the Digital Markets Act)

A Pioneering Precedent

The FCO’s case has set crucial legal benchmarks:

  1. It established that privacy abuses can constitute antitrust violations
  2. It influenced the EU’s Digital Markets Act (DMA)
  3. It prompted a 2023 CJEU ruling limiting Meta’s tracking practices

“Our decision has given users much greater control over their data,” said Andreas Mundt, President of the Bundeskartellamt. While enforcement continues across Europe, this case represents a significant step in curbing unchecked data collection by tech giants.
