Netflix Faces New Patent Lawsuit from OpenTV and Nagra Amid Streaming Wars
Legal Battle Escalates in the Digital TV Space
Streaming giant Netflix finds itself embroiled in yet another patent lawsuit, this time filed by OpenTV and its sister company Nagra in the U.S. District Court for the Northern District of California. The suit targets four patents related to digital TV services, adding to Netflix’s growing list of legal challenges in the competitive streaming landscape.

This marks at least the third patent case brought against Netflix by Kudelski Group, the Swiss parent company of OpenTV and Nagra. Previous lawsuits include:

The timing is notable, coming just days after Kudelski filed a similar patent infringement case against Apple, targeting five different patents related to digital media services.

- 7,644,429: “Broadcast and Reception, and Conditional Access System Therefor”
- 8,332,268: “Method and System for Scheduling Online Content Delivery”
- 8,621,541: “Enhanced Video Programming System and Method Utilizing User-Profile Information”
Behind the Legal Strategy
Court documents reveal that OpenTV first notified Netflix CEO Reed Hastings about potential patent conflicts in December 2011, but discussions failed to produce a licensing agreement. The lawsuit appears to be an escalation tactic to force negotiations.
Leading Kudelski’s legal strategy is Joe Chernesky, SVP of Intellectual Property, who joined the company in May 2012 from Intellectual Ventures, a well-known patent licensing firm.

While many patent lawsuits are dismissed as frivolous “trolling,” Kudelski’s case carries more weight:
